President enjoys immunity, Gilani tells SC

ISLAMABAD: Prime Minister Syed Yusuf Raza Gilani Thursday defended himself against charges of contempt to the Supreme Court (SC), refusing to apologize when I've seen him removed from office if convicted.

This is only the second time that the court had initiated contempt the top of the case against sitting prime minister.

The court summoned the prime minister Gilani to explain his refusal to ask Switzerland to reopen the graft case against President Asif Ali Zardari.

Give his opinion before the seven-member bench, Prime Minister Syed Yousuf Raza Gilani said that the President enjoys complete immunity not only in Pakistan but also in the world enshrined in the Constitution.

He said that he could not even think about dishonoring or disgracing the court.

PM Gilani said that he appeared in person to comply with court rulings that have indicated their respect and honor for the court.

About writing a letter to open a Swiss court case, the Prime Minister said that the president enjoys immunity in Pakistan and abroad, so he never wrote a letter to the Swiss court.

"It does not give a good message to take action against a president who is elected by a two thirds majority vote."

According to him, PPP leaders have always respected and revered by the courts and execute their orders.

Gilani said Zulfikar Ali Bhutto and Begum Nusrat Bhutto, also appeared in court, said that the respect and honor these vessels leaders.

According to him, the presence of the leaders of the coalition partners in the court, to reflect their respect for the judiciary.

Said Prime Minister Benazir Bhutto was a great leader and politician, and he followed his mission.

He said that the country is united and integrated in relation to the 1973 Constitution, which was restored by the present government in its original form.

Justice Asif Khosa, evaluating the presence of Prime Minister Gilani in court, he said, indicated that there is rule of law, as executive director of the country found itself in court.

PM Gilani along with other leaders and members of his Cabinet attended the trial and personally presented their views to the bench.

He said that he and President Asif Zardari had to face imprisonment, but they have never done any dishonor to the court.

During the trial, Aitzaz Ahsan said that I am here only to protect the PM Gilani, and not the secretary of the Act.

"Only the law can inform the Secretary as to why he did not write summaries detail the head of state immunity."

He also said that Asif Zardari before holding the office of the president, the letter can not be recorded on the Swiss authorities, as he enjoyed immunity in accordance with Article 248 of the Constitution.

The verdict of the Supreme Court will be, when President Asif Ali Zardari is no longer president, said Aitzaz Ashan. This is no ordinary event and need a one month time to prepare, he pleaded.

Justice Khosa said the bench should be informed if anyone is immune.

Justice Nasir-ul-Mulk said that this is just a preliminary procedure and time has not come to the indictment.

Justice Usmani asked the prime minister Aitzaz Ahsan's lawyer that the government would write a letter to Swiss authorities, if it is proved that the president has no immunity.

The court, with the connivance of the Prime Minister of the proceedings and adjourned the hearing until February 1
